Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you and AdsGen.ai ("AdsGen", "we", "us", or "our") and govern your access to and use of our website and services. By creating an account, subscribing to a plan, or using AdsGen, you agree to these Terms. If you are using AdsGen on behalf of a company, you confirm that you have authority to bind that company. If you do not agree, do not use AdsGen.

The service

AdsGen is an AI video ad generator. You provide a product URL or a description of what you sell, and AdsGen writes a hook and script, casts an AI creator, and renders creator-style UGC video ads with burned-in captions in native vertical format. You can download the finished video files and run them on the advertising platforms and social networks of your choice.

Accounts and eligibility

You must be at least 18 years old and able to enter into a binding contract to use AdsGen. You agree to provide accurate, current, and complete information when you register and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at team@adsgen.ai if you suspect unauthorized use.

Subscriptions, fees, and billing

AdsGen is offered on a subscription basis with a flat fee, charged in US dollars. Fees recur automatically each billing period until you cancel. You can cancel at any time, and your subscription will remain active through the end of the current paid period. Fees already paid are non-refundable, and we do not provide refunds for partial billing periods. Plans include a defined amount of ad generation each period; details of your plan limits are shown at checkout and in your account.

AI-generated content and your responsibility

AdsGen produces video ads automatically using AI. While we work to make output that is high quality and on-message, AI-generated content can contain mistakes, inaccuracies, or claims that do not fit your product or market. You are responsible for reviewing every ad before you publish it. You are solely responsible for the products and services you advertise, for the accuracy and legality of the claims in your ads, and for ensuring each ad complies with all applicable laws and with the policies of any platform where you run it. AdsGen makes the ads; you decide what to run and where.

Ownership and license to generated ads

AdsGen and all related software, models, designs, text, and branding are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. Subject to your compliance with these Terms and payment of applicable fees, you own the video ads AdsGen generates for you and may use them in connection with your own advertising and marketing. You retain ownership of the product inputs you provide, and you grant us the rights needed to process those inputs and operate and improve the service.

Acceptable use

You agree not to misuse AdsGen. You will not attempt to reverse engineer, copy, or resell the service, interfere with its operation or security, access it without authorization, or use it to create ads for illegal, deceptive, infringing, hateful, or harmful products. You will not use generated creators or content to impersonate a real person, to mislead about who is endorsing a product, or in any way that violates the rights of others. We may suspend or limit access if we reasonably believe you are violating these Terms or harming the service or other users.

No guarantee of performance

Advertising results depend on many factors outside our control, including your offer, market, targeting, budget, and platform conditions. Any benchmarks, averages, or example results we share are illustrative and are not promises or guarantees of future performance. We do not guarantee that the ads you create will be approved by any platform or that they will generate any particular level of views, clicks, leads, or sales.

Third-party platforms

You choose where to upload and run the ads you create with AdsGen. Your use of any advertising platform or social network is subject to that platform's own terms and policies. We are not responsible for the decisions, actions, or availability of those platforms, including ad disapprovals, account restrictions, or policy changes.

Disclaimers and limitation of liability

AdsGen is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, AdsGen and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or ad spend. Our total liability for any claim relating to the service will not exceed the amount you paid us for the service in the three months before the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless AdsGen and its officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable legal fees, arising out of your use of the service, the ads you create and run, your content, or your violation of these Terms or of any law or third-party rights.

Termination

You may cancel your subscription at any time from your account. We may suspend or terminate your access if you violate these Terms, fail to pay, or use the service in a way that creates risk or legal exposure for us or others. On termination, your right to use AdsGen ends. Provisions that by their nature should survive termination will continue to apply.

Governing law

These Terms are governed by the laws applicable to AdsGen's place of business, without regard to conflict-of-law rules. The courts located there will have exclusive jurisdiction over any dispute, unless otherwise required by applicable law.

Changes to terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of AdsGen after an update means you accept the revised Terms.
